The petitioner seeks bail in connection with Chakia P.S. Case No. 329 of 2019, registered under Sections 386 and 387 of the Indian Penal Code.

The accusation is that on 21.09.2019, informant, Ajay Kumar, Manager of Adi Chitragupta Finance Limited, Chakia, Motihari, received the message on his mobile sent from two mobile numbers, i.e., 9122770457 and 7255015965 and the caller, on query, made demand of ransom of R.2,00,000/- saying that otherwise he will be killed.

Submission is that petitioner is not named in the first information report. On the basis of tracking of the mobile the petitioner was apprehended as the mobile number 9122770457 belongs to the petitioner. Further, submission is that in fact the

No.82342 of 2019(2) dt.12-12-2019 2/2 petitioner had gone to hospital for seeing the patient where one person showing urgent work took his mobile and at a short distance he talked with someone and returned his mobile. At that time, the mobile of the petitioner was used by a miscreant to whom the petitioner had no knowledge. The petitioner has no criminal antecedent and is in custody since 23.09.2019. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Chakia P.S. Case No. 329 of 2019 to the satisfaction of the Additional Chief Judicial Magistrate, XIII, East Champaran at Motihari, subject to the condition that out of two bailors, one must either be parent or close relative of the petitioner.
