JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-07-2021 Heard Mr. Vibhakar Kumar, learned Advocate for the petitioner and Mr. Rakesh Kumar Singh, Advocate for the Bank. Mr. Narsingh Tanti, learned App has assisted this Court on behalf of the State. The petitioner seeks bail in anticipation of his arrest in connection with Piribazar P.S. Case No. 43 of 2018 dated 02.05.2018 instituted for the offences under Sections 419, 420, 409, 467, 468 and 471 of the Indian Penal Code.

He is said to have obtained a loan of Rs.

Fourteen Lakhs for the purchase of a harvester which was never purchased by him. It appears from the order dated 16.06.2020 that the petitioner expressed hope

Patna High Court CR. MISC. No.85631 of 2019(7) dt.06-07-2021 2/2 that the matter would be settled by negotiation with the bank. On the strength of such statement, interim order was passed in his favour.

However, today the learned counsel for the petitioner submits that he is not in a position to respect his undertaking.

In that view of the matter, the petition is dismissed but with the liberty to him to approach the court below for regular bail.

Should such a petition be filed, the court below shall look into the entire set of facts and shall pass orders in accordance with law without being prejudiced by the fact that the present petition on his behalf has not been entertained ultimately.

The petition stands disposed off.
