The petitioner seeks bail in connection with Ghorasahan P.S. Case No. 131 of 2018 registered under Section 30(a) of Bihar Prohibition and Excise Act-2016. 120 lts. of Nepali Saufi wine is said to have been recovered from mango orchard of Harihar Das and petitioner and one other accused, namely, Lal Bachchan were apprehended hiding them behind the tree in the said orchard. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern either with the seized liquor or with the place of
Patna High Court Cr.Misc. No.41558 of 2018(2) dt.11-07-2018 2/2 recovery. He has been falsely implicated in this case by the police merely on suspicion while he was sitting under the shed of the tree at the edge of the said orchard. He has no criminal antecedent. He has been languishing in custody since 07.04.2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Motihari, East Champaran in connection with Ghorasahan P.S. Case No. 131 of 2018.
