Petitioner is in custody since 10.05.2018 in connection with Economic Offences Unit P.S. Case No. 01 of 2012 (Special Case No. 02 of 2017) registered under Sections 406, 409, 420, 465, 468, 471, 120(B) of the Indian Penal Code and 13(2) read with Section 13(1)(d) of P.C. Act.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner happens to be the then Panchayat Sewak at Harpur Panchayat and he has not played any role in the alleged defalcation. Moreover, several co-accused such as the then

Patna High Court Cr.Misc. No.41147 of 2018 (2) dt.19-07-2018 Block Development Officer, the then Mukhiya and the successor of Block Development Officer and even In-charge of the Indira Awas Yojna have already been granted bail by the High Court. The petitioner is rotting in judicial custody for the last two months. Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vigilance, North Bihar, Muzaffarpur in connection with Economic Offence Unit P.S. Case No. 01 of 2012.
