2. This is the third attempt of the petitioner. Earlier the bail application of the petitioner was rejected twice vide order dated 14.07.2023 and 23.02.2024 passed in Cr. Misc. No. 41954 of 2023 and Cr. Misc. No. 1462 of 2024 respectively.

3. The petitioner seeks regular bail in connection with Riga P.S. Case No.18 of 2023, registered for the offence under Sections 366A of the Indian Penal Code.

4. As per the prosecution case, the petitioner is said to have committed rape with a minor girl.

5. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.813 of 2025(3) dt.27-06-2025 2/2 petitioner is innocent and has falsely been implicated in this case. The petitioner is in custody since 15.02.2023.

6. Learned A.P.P. has vehemently opposed the prayer for bail.

7. The trial is pending. The learned Trial Judge has sent a report that he will conclude the trial within six months.

8. Considering the aforesaid facts and circumstances and the fact that there is serious allegation against the petitioner of kidnapping and committing rape upon minor victim, I am not inclined to grant bail to the petitioner.

9. Accordingly, this application for regular bail is hereby rejected.

10. The Superintendent of Police, Sitamadhi, will ensure the appearance of all the witnesses in the trial on the date fixed.

11. Let a copy of this order be communicated to the Superintendent of Police, Sitamadhi and the Principal District and Sessions Judge, Sitamadhi, through FAX for its compliance forthwith.
