Petitioners are apprehending their arrest in connection with Bakhtiyarpur P.S.Case No.193 of 2019 , registered for offences punishable under Sections 3)(a)(c)(d) of Bihar Prohibitino Excise Act, 2016.

As per FIR, police on information of manufacturing of liquor , raided upon river Ganga but the accused persons succeeded in fleeing away. It appears that there is recovery of country-made liquor as well as some articles also. Petitioners are named in the FIR as the person who succeeded in fleeing away.

Submission of the learned counsel for the petitioners is

Patna High Court CR. MISC. No.83535 of 2019(2) dt.17-12-2019 2/2 that except they are named as the persons who succeeded in fleeing away, there is absolutely nothing . Nothing recovered from them or at their instance or from the place of the occurrence.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Bakhtiyarpur P.S.Case No.193 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
