JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2019 Petitioner seeks regular bail in connection with Brahampura P. S. Case No. 377 of 2019, registered for the offences punishable under Sections 323, 341, 504, 506, 379, 34 of IPC and Section 37(b) (c) of the Bihar Prohibition & Excise Act, 2016.
As per F.I.R. there is allegation against the petitioner of dragging the Dupatta of the informant and when she narrated the incident to her husband, she was also abused and assaulted by the petitioner. She was also assaulted by Bijendra Kumar Mahto, mother of Bijendra Mahto, Mannu Kumar and Sunil Kumar. It is said that they were in drunken conditions. Submission of the learned counsel for the petitioner is that the allegation of assault is against the other co-accused persons and moreover, the petitioner is in custody since

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise, Muzaffarpur, in connection with Brahampura P. S. Case No. 377 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
