====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 31-01-2024 Heard Mr. Gagandeo Yadav, learned counsel for the petitioner, Ms. Minakshi Kumari, learned counsel for the informant and Mr. Nawal Kishore Prasad, learned APP for the State.
2. Petitioner apprehends his arrest in connection with Benipatti PS Case No. 113 of 2023 dated 05.06.2023 registered for the offences punishable under Sections 147, 148, 341, 323, 307, 354(B), 504, 506, 379, 120(B) of the Indian Penal Code.
3. As per First Information Report the petitioner along with two other accused persons assaulted the informant by means of Garasa, iron rod, and Lathi.
4. Learned counsel for the petitioner submits that both the parties are closely related and the informant and

He further submits that there is allegation of assault on three accused persons but learned Additional Sessions Judge- 3rd, Madhubani has granted anticipatory bail to Randhir Yadav and Dhanvir Yadav but refused the prayer for bail of the petitioner. Learned counsel, referring to Annexure-2, injury report, submits that the doctor has given vague injury report and his opinion says that the injury may be dangerous.

On the other hand, learned counsel for the informant vehemently opposed the prayer for anticipatory bail and submits that the allegation against the petitioner is that he assaulted the informant by means of Garasa whereas two other accused persons, who have been granted bail by the court below, are said to have assaulted by means of iron rod and lathi.

Having regard to the submissions made by the parties, taking into consideration the fact that the allegation of assault upon the informant is against three persons and two of them have been granted bail by the court below itself. Accordingly, I am inclined to grant anticipatory bail to the petitioner.
7. Accordingly, in the event of arrest/surrender before the court below within six weeks from today, petitioner, named

No.104 of 2024(2) dt.31-01-2024 3/3 above, shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Benipatti, District-Madhubani in connection with Benipatti PS Case No. 113 of 2023, subject to the condition as laid down under Section 438(2) of the CrPC.
