This application is for grant of regular bail in connection with Hathidah P.S.Case No.52 of 2017 for the offences under Sections 395 and 412 of the Indian Penal Code. Petitioner is not named in the FIR and later on his name transpired during the course of investigation of the case and the looted double-barrel gun has been recovered from the possession of the petitioner and it further appears that he is accused in four other cases.

Submission of the learned counsel for the petitioner is that he has been named on the basis of confessional statement and another co-accused person has been granted bail vide order dated 10.7.2018 passed in Cr. Misc. No.37731 of 2018.

Patna High Court Cr.Misc. No.41106 of 2018 (3) dt.25-09-2018 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail stating that the looted gun has been recovered form the house of the petitioner.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.

With the aforesaid observation, this application is dismissed.
