====================================================== CORAM: HONOURABLE MR. JUSTICE A. ABHISHEK REDDY ORAL ORDER 22-12-2025 Without going into the merits or demerits of the case, the present writ petition is disposed of at the stage of admission with the consent of both the counsels.

Learned counsel appearing on behalf of the petitioner submits that the petitioner pursuant to the order dated 30.04.2024 passed in CWJC No. 13792 of 2016 (Annexure 4) has given a representation dated 10.05.2024 (Annexure P/5 series) to the Respondent No. 5, i.e., the District Land Acquisition Officer, Madhubani but till date the authority has

Patna High Court CWJC No.20266 of 2025(2) dt.22-12-2025 2/3 not passed any orders. Learned counsel submits that the authority may be directed to dispose of the representation made by the petitioner by fixing a time frame.

Per contra, the learned counsel appearing on behalf of the respondents-NHAI as well as the respondents-State submit that the representation made by the petitioner may not be be available with the respondent authority as the petitioner has not filed any proof of service of the same and he has simply sent the said representation through the registered post. Learned counsel submits that the petitioner may be directed to give a fresh representation to the Respondent No. 5, i.e., the District Land Acquisition Officer, Madhubani and the same may be considered strictly in accordance with law and necessary orders passed.

Having regard to above made submission, the present writ petition is disposed of granting liberty to the petitioner to give a suitable representation to the Respondent No. 5, i.e., the District Land Acquisition Officer, Madhubani ventilating his grievance within a period of four weeks from today. On such representation being given, the Respondent No. 5, i.e., the District Land Acquisition Officer, Madhubani shall consider the same and pass necessary orders strictly in

Patna High Court CWJC No.20266 of 2025(2) dt.22-12-2025 3/3 accordance with law duly taking into account the contents of the representation as well as the documents submitted along with the said representation. Any order passed shall be communicated to the parties. The authority shall endeavor to pass necessary orders as expeditiously as possible preferably within a period of 12 weeks from the date of receipt of the representation from the petitioner.

5. With the above directions, the present writ petition stands disposed of.
