JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-12-2019 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Madhubani Town P.S. Case No. 205 of 2019 for the offence under Section 379 of the Indian Penal Code.

Allegation against the petitioners is that they were involved in theft of motorcycle.

Learned counsel for the petitioners submits that the petitioners were not named in the F.I.R. He further submits that the petitioners are in custody since 05.08.2019, yet they have not been put on Test Identification Parade.

Considering the fact that the petitioners were not named in the F.I.R. and they have not been put in T.I.P. despite the fact that they are in custody since 05.08.2019, the
