JUSTICE ARVIND SRIVASTAVA ORAL ORDER 18-07-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner is in custody since 31.05.2018 in connection with Mansi P.S. Case No. 70 of 2016, G.R. No. 715 of 2016 registered under Sections 341, 363 and 365 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner has not been named in the F.I.R. and he has falsely been implicated in this case. Moreover, a complaint being Complaint case No.1031 (C) of 2017 has also been filed against the informant. Moreover, the named accused have already been granted the privilege of anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 14333 of 2018 and the petitioner is rotting in judicial custody for two months.

Considering the facts and circumstances of the case, let

Patna High Court Cr.Misc. No.41536 of 2018 (2) dt.18-07-2018 the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No. 70 of 2016.
