JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 The petitioner seeks regular bail in connection with Basopatti P.S. Case No. 266 of 2019, registered for offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of altogether 261 litres of liquor from two motorcycle and petitioner has been arrested as one of the motorcycles belonged to him.

It has been submitted on behalf of the petitioner that he has no criminal antecedent and has falsely been implicated in this case and he has been in judicial custody since 08.11.2019 and chargesheet has been submitted and there is no chance of tampering with the evidence.

Having heard both sides, in view of the submissions

Patna High Court CR. MISC. No.80503 of 2019(2) dt.13-01-2020 2/2 as above, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II-cum-Special Judge (Excise) Act, Madhubani, in connection with Basopatti P.S. Case No. 266 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
