Petitioner apprehends his arrest in connection with Civil Lines P.S.Case No. 90 of 2018 registered for the offences punishable under Sections 406, 409, 420, 120B and 34 of the Indian Penal Code.
Allegation as per FIR is of defalcation of stipend amount and further allegation is that cheques were issued in the name of fake persons, which were deposited at Merrut and other places and the same were sent to HDFC Bank, Gaya for clearance and petitioner is Branch Manager of the said Bank. Submission of learned counsel for the petitioner is that there are procedural lapses and petitioner has no role to play in respect of clearance of cheques as the same has been done by

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Civil Lines P.S.Case No. 90 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
