====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 19-02-2025 Heard Mr. Vijay Kumar, learned counsel appearing on behalf of the petitioner and Mr. Anuj Kumar Shrivastava, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Jamui P.S. Case No. 492 of 2024 registered for the offence(s) punishable under Sections 329(4), 115(2), 110, 352, 303(2), 3(5)of BNS.

3. As per the allegation made in the FIR, the accused persons named therein including the petitioner with a common intention assaulted the informant on different parts of his body including on his head.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.4791 of 2025(2) dt.19-02-2025 2/3 petitioner submitted that petitioner is innocent and has falsely been implicated in the present case. There is case and counter case between the parties arising out of the same incidence and due to land dispute, an altercation took place and both the sides entered into fierce fight and in the self-defence, petitioner may have caused some injury on the person of the informant. On these grounds, petitioner seeks to be released on pre-arrest bail.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

Considering the nature of allegation made in the FIR, as well as, the fact that there is case and counter case between the parties arising out of the same incidence and due to land dispute, an altercation took place and both the sides entered into fierce fight and in the self-defence, petitioner may have caused some injury on the person of the informant, I am of the opinion that petitioner has, prima facie, made out a case to be released on pre-arrest bail.

7. The petitioner, above named, is directed to be released on pre-arrest bail, in the event of his/her arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
