1. Heard learned counsel for the parties.

2. The petitioner has renewed his prayer for grant of regular bail in connection with Kankarbagh P.S Case no.880 of 2022 registered under sections 420 and 379 of the Indian Penal Code.

3. The earlier application for bail of the petitioner was rejected vide order dated 1.11.2023 (Annexure P/1) passed in Cr. Misc. no.72379 of 2022.

4. As per the prosecution case, the petitioner who happens to be the tenant of the informant's father, took the informant's father into confidence and through various means as described in the F.I.R withdrew large sums of money through cheques, ATM cards etc.

5. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.1353 of 2024(2) dt.12-01-2024 2/2 charge has been framed against the petitioner in the learned trial Court on 8.11.2023 which would be evident from the copy of the order sheet brought on record as Annexure P/3 to this petition. The petitioner is in custody since 22.10.2022 and undertakes to cooperate in the trial.

6. The prayer for bail is opposed by learned A.P.P for the State.

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the F.I.R, his being in custody for more than 1 year since 22.10.2022, the liberty granted in the earlier order of rejection dated 1.11.2023 and charge having been framed against the petitioner vide order dated 8.11.2023 (Annexure P/3) read with the statement made in paragraph no.19 of the petition, the petitioner is directed to be enlarged on bail in connection with Kankarbagh P.S Case no.880 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna.
