JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-07-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Pirpainty P.S.Case No. 362 of 2017 (G.R. No. 6957 of 2017), registered for offences punishable under Sections 341, 323, 379, 327, 307, 504, 506 and 34 of the Indian Penal Code. As per F.I.R., allegation against the petitioners is of try to capture the land of the informant and when on 11.12.2017 the petitioners again tried to capture another land of the informant upon which the informant and her husband made protest then the accused persons abused and threw the informant on the ground and started pressing her neck, causing injury. Submission of the learned counsel for the petitioners
Patna High Court Cr.Misc. No.44104 of 2018 (2) dt.26-07-2018 2/2 that both the parties are co-sharers and there is land dispute between the parties and the injuries found on the person of the informant, is simple in nature Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, surrender be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Pirpainty P.S.Case No. 362 of 2017 (G.R. No. 6957 of 2017), subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
