2. The petitioner seeks bail in connection with Muffasil P.S. Case No. 404 of 2023 registered for the offence punishable under Sections 302/34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. The petitioner is the assailant of the deceased. This is the second attempt of the petitioner for grant of bail. Earlier his application was rejected vide order dated 19.07.2024 passed in Cr. Misc. No. 42793 of 2024.

4. In the trial, four private witnesses have been examined. The official witnesses namely the doctor and the Investigating Officer are to be examined. This application is dismissed in view of the judgment of the Hon'ble Supreme

Patna High Court CR. MISC. No.47 of 2025(2) dt.18-01-2025 2/2 Court passed in the case of X Vs. State of Rajasthan & Anr. reported in 2024 SCC Online SC 3539.

6. The Superintendent of Police, Begusarai is directed to produce remaining officials witnesses in the trial at the earliest.
