2. The petitioner has preferred this application for grant of regular bail in connection with Ramkrishna Nagar P.S. Case No. 479 of 2024 registered for the offences punishable u/s 302 read with Section 34 of the I.P.C.
3. As per the prosecution case, the wife of the informant, namely, Kiran Devi, was having a love affair with Kuldeep Kumar (Petitioner). It is alleged that she had left the house along with her two children. On 24.06.2024, the informant received information from the police that his wife was killed. Thereafter, the informant raised suspicion that it was Kuldeep Kumar (petitioner) along with his other family members, who killed his wife.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner was not apprehended from the place of occurrence and during the course of the investigation, the children of the informant who were present in the room where the wife of the informant was found dead, had stated that their mother had been killed by their father. It is next submitted that there is no material to connect the petitioner with the alleged crime. It has also been pointed out that the cause of death, as per the post-mortem report, was asphyxia caused due to pressure over neck by ligature. It is lastly submitted that the petitioner has clean criminal antecedents and is in custody since 25.06.2024.
5. Learned APP for the State has vehemently opposed the prayer for bail and has stated that the petitioner is alleged to have killed the wife of the informant, hence, he does not deserve the liberty of bail.

Considering the aforesaid submissions of the parties and taking into account the fact that during the course of the investigation, nothing has come to connect the petitioner with the alleged incident and on the contrary, the children had stated that their mother (deceased) was killed by their father

No.2759 of 2025(5) dt.13-05-2025 3/3 (informant) and also considering the fact that the petitioner is in custody since 25.06.2024, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna, in connection with Ramkrishna Nagar P.S. Case No. 479 of 2024.
7. The learned Court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
8. The application stands allowed.
