JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24.07.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under section 302 and other minor sections of the IPC and 27 of the Arms Act.

The accusation against the petitioner is that he along with five other FIR named accused assaulted the deceased Ashutosh Kumar @ Hulchul Rai by means of sharp edged weapon but learned counsel for the petitioner points out that while considering bail prayer of co-accused Mohan Ray in Cr. Misc. no. 6782/2018, a coordinate bench of this court got opportunity to look into the post mortem report of the deceased and found that the deceased sustained

Patna High Court Cr.Misc. No.43547 of 2018 (2) dt.24-07-2018 one single injury on his head said to be caused by hard and blunt substance. Learned counsel further submits that coordinate bench of this court taking note of the aforesaid fact vide order dated 5.3.2018 granted bail to co-accused Mohan Ray.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge VI, Ara in Sessions trial no. 243/2017 arising out of Sikarhata P.S. Case no. 12/2017. shahid (Hemant Kumar Srivastava,J) U T
