Petitioner apprehends arrest in a case registered for the offences punishable under Sections 307/34 and other ancillary sections of the Indian Penal Code.

Learned counsel for the petitioner submits that the parties are agnate, there is case and counter case between the parties and there is land dispute between the parties. The injuries caused by the accused persons have been found to be simple in nature. Petitioner has got no criminal antecedent. Considering the facts of the case, let the petitioner, above named, in the event of arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran in Bairiya Police Station Case No. 251 of 2019 on the following conditions:-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court

Patna High Court CR. MISC. No.82191 of 2019(2) dt.12-12-2019 2/2 and shall remain physically present as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
