JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 The petitioner seeks regular bail in connection with Jaynagare P.S. Case No. 354 of 2019, registered for offences punishable under Sections 302, 201, 120(B) of the Indian Penal Code.

Allegation as per F.I.R. is that petitioner has taken the son of the informant with himself and later on his dead body was recovered. It is also alleged that there was dispute between the petitioner and the deceased.

It has been submitted on behalf of the petitioner that save and except suspicion, there is absolutely nothing against the petitioner and he has no criminal antecedent and has been in judicial custody since 24.07.2019.

Learned counsel for the State opposed the prayer for bail and submitted that apart from the last seen, there are

No.80824 of 2019(3) dt.14-01-2020 2/2 circumstances against the petitioner that there was previous enmity between the deceased and petitioner with respect to land dispute and one of the witnesses has also seen the petitioner and other accused persons at the place, where the dead body of the deceased was found.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail.

This application is accordingly dismissed.
