JUSTICE PURNENDU SINGH ORAL ORDER 19-02-2025 Heard Mr. Digvijay Kumar Ojha, learned counsel appearing on behalf of the petitioner; Mr. Sanjay Kumar, learned counsel appearing on behalf of the opposite party no. 2 and Ms. Suman Kumari Singh, learned A.P.P. for the State.

2. The petitioner seeks pre-arrest bail in connection with Jehanabad P.S. Case No. 456 of 2021, registered for the offence punishable under Sections 498A/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

3. The present case relates to strained matrimonial dispute between the petitioner and opposite party no.2, who are husband and wife.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.2054 of 2025(3) dt.19-02-2025 2/3 petitioner submitted that petitioner is man of means and he is employed and is working in Delhi. Petitioner has all affection for opposite party no. 2 and he wants to live along with the opposite party no. 2 at his present place of employment in Delhi but the opposite party no. 2 is more interested in getting maintenance.

Learned counsel appearing on behalf of the opposite party no. 2 submitted that opposite party no. 2 is the first wife of the petitioner and she has every right in the property and petitioner had willingly desired to make payment of Rs. 15,000/- per month in light of order dated 20.12.2022 passed by the learned Family Court in Maintenance Case No. 39 of 2021 and for execution of the same, as the petitioner has declined to make aforesaid payment, execution case being Miscellaneous No. 50 of 2023 was filed which is pending before the learned Family Court having jurisdiction.

6. In view of the above fact, I find that the petitioner may resolve his dispute by abiding by the judicial Order. Learned District Court is directed to send both the parties for mediation to the District Medication Centre, Jehanabad, so that they can reconcile their strained matrimonial relationship.

7. The parties have agreed to appear before the

Patna High Court CR. MISC. No.2054 of 2025(3) dt.19-02-2025 3/3 learned District Court on or before 27.02.2025 at 10.30 A.M., so that they can proceed to reconcile in presence of the learned Mediator. Till then, no coercive step shall be taken against the petitioner in connection with the aforesaid case.

8. The learned District Court is directed to take appropriate steps in this regard.

9. Learned Mediator is directed to furnish report to the learned District Court within a period of four months.

10. Learned District Court is directed, thereafter, to pass appropriate order in accordance with law.

11. With the aforesaid observation and direction, the bail application stands disposed of.
