2. This application, for grant of anticipatory bail, arises out of Suppi Police Station Case No. 193 of 2025, disclosing offences under Section 30(a) of Bihar Prohibition and Excise Act and Sections 25(1-B)(a), 26 and 35 of Arms Act.

3. As per the First Information Report, in brief, is that 180 litres of illicit liquor along with one country-made pistol, five cartridges etc. were recovered from a boat. The arrested co-accused, namely, Priyanshu Kumar disclosed the name of two escaped person as Balraj Singh @ Bhuntun

4. Learned Counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has come on the discloser made by arrested co-accused, namely, Priyanshu Kumar. Recovery has been made from a boat, which is an open space, accessible to all and sundry. Nothing has been recovered from the conscious possession and/or premises belonging to the petitioner. Co-accused person has already been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 24.09.2025 passed in Cr. Misc. No. 63487 of 2025. Petitioner is having no criminal antecedent.

Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that similarly situated co-accused person has already been granted anticipatory bail by a Co-ordinate Bench of this Court, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of
