2. The petitioner is apprehending his arrest in connection with Phulwarisharif P.S. Case No. 848 of 2025 for the offence under Sections 126(1), 115(2), 316(2), 318(4) and 352(3)(5) of the BNS.

As per the prosecution story, the informant has alleged that while searching for a suitable groom for her daughter Priyanka Bharti, she was introduced through a mediator to Guddu Kumar of Khusrupur, who was allegedly working in the Railways. After meetings between the families on 21.07.2024 and 23.07.2024, the accused persons
2/4 agreed to the marriage and Chheka ceremony was performed, during which the complainant paid a total sum of Rs, 10,00,000/- in cash as gift/advance, supported by photographs and video. Thereafter, the accused persons repeatedly avoided fixing the marriage date and, on the pretext of house renovation, demanded and obtained further money. When the complainant later visited the accused's house on 21.05.2025 to finalize the marriage, the accused demanded an additional amount of Rs. 10,00,000/- and stated that they had another proposal offering Rs. 20,00,000/-. Upon demanding return of the amount already paid, the complainant and her son were abused and her son was assaulted, and the accused flatly refused both to solemnize the marriage and to return the money. It is further alleged that due to the accused persons' acts of cheating, abuse, assault, and threats, the complainant's daughter suffered humiliation, loss of social prestige, and was even instigated to commit suicide.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case with an ulterior motive to harass him. It is
3/4 contended that the petitioner received only Rs. 1,00,000/- (One Lakh Rupees) in cash, which was duly returned to the informant on 20.05.2025, as the informant had failed to provide the requisite documents and bio-data of the petitioner's nephew and his family despite considerable time having elapsed. Learned counsel further submits that the informant had pre-planned to solemnize her daughter's marriage with the petitioner's nephew and has, therefore, concocted a false and misleading story. It is also submitted that the petitioner lives separately in mess and business from the father of Guddu Kumar and has no role in the alleged transactions. As per para 3 of the bail application, the petitioner has a clean antecedent.
5. Learned APP opposes the prayer for bail.
6. Keeping in view the aforesaid facts, this Court is inclined to extend him the privilege of anticipatory bail.
7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the date of receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned
4/4 Additional Chief Judicial Magistrate, IV Patna, in connection with Phulwarisharif P.S. Case No. 848 of 2025 subject to the conditions as laid down under Section 482 of B.N.S.S., as also with the condition that one of the bailors should be close relative of the petitioner.
