The petitioner, who is in custody, seeks bail in connection with Kunouli P.S. Case No. 5 of 2017 registered for the offence punishable under Section 302/34 of the Indian Penal Code.

The FIR is registered against unknown persons, who committed murder of husband of informant.

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case because petitioner was Gotia of the deceased and there was land dispute of Rasta. It has been further submitted that similarly place co-accused, namely, Santosh Jha has been granted anticipatory bail by this Hon'ble Court vide Cr. Misc.

Patna High Court Cr.Misc. No.43669 of 2018(3) dt.24-09-2018 2/2 No. 29750 of 2018 vide order dated 17.05.2018. Petitioner has no criminal antecedent and he is in custody since 05.06.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Learned J.M. Birpur (Supaul), in connection with Kumouli P.S. Case No. 05 of 2017.
