2. Permission is accorded.

3 . This bail petition with respect to petitioner No. 1 is dismissed as withdrawn .

4. Heard learned counsel for petitioner No. 2 informant and learned A.P.P. for the State .

5 . The petitioners apprehend their arrest in a complaint case punishable for the offence under Sections 126

Patna High Court CR. MISC. No.87407 of 2025(2) dt.17-01-2026 2/3 ( 2 ), 115 ( 2 ), 352, 61 ( 2 ), 61 ( 2 ) and 85 of BNS.

6. As per prosecution case , informant alleged that she has love affair with co-accused Manish Kumar, who established physical relationship with her on the false promise of marriage due to which she became pregnant. It is further alleged that when informant asked to get marry her then accused persons began to make pressure upon informant for miscarriage but informant refused to do it and to keep her baby safe from this condition , she began to live on rent at Postal Park Patna and gave birth to a baby girl was born . It is further alleged that on 30.04.2025 , informant requested co-accused Manish Kumar to accept her as his wife but he refused to do so and then all the accused persons including this petitioner threatened her and tried to kill the informant.

7. It is submitted on behalf of petitioner that she is innocent and has committee no offence as alleged. Petitioner has falsely been implicated in this case because she happens to be mother of co-accused Manish Kumar against whom there is specific accusation . Petitioner has got no concern with the affairs of informant and co-accused Manish Kumar. Petitioner claims clean antecedent.

8 . Learned A.P.P. for the State as well as informant

Patna High Court CR. MISC. No.87407 of 2025(2) dt.17-01-2026 3/3 vehemently opposed the prayer for anticipatory bail of petitioner.

9. Considering the fact that specific accusation is against co-accused Manish Kumar, clean antecedent of this petitioner and other circumstances of case , let the above named petitioner No. 2 in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM Gopalganj in connection with Gopalganj ( Town) P S Case No. 342 of 2025 , subject to condition as laid down under Section 482 (2) of BNSS 2023 .
