For issuance of an appropriate writ restraining the Respondents not to construct Model Deluxe Latrine / Toilet or any other construction and remove the mobile latrine as per e-tendering no. 1/2023-24, item no 73, installed in front of the petrol pump of the petitioner."

At the outset, the learned counsels appearing for the Respondent-State as also for the Municipal Corporation, Nagar Parishad, Jamalpur, submit, by referring to the counter affidavit filed in the present case that the toilets in question have already been removed.

In view of the aforesaid, the learned counsel for the petitioner submits that if it be so, the present writ petition be disposed off, however, reserving liberty to the petitioner to approach the District Magistrate, Munger / Chief Executive Officer, Nagar Parishad, Jamalpur, in case of any subsisting grievances. Liberty, so sought, is granted.
