ANJANA MISHRA ORAL ORDER 10-08-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner, being the husband of the deceased, is in custody since 22.03.2016 in connection with S.T. No.764/16 arising out of Shashtrinagar P.S. Case No.120 of 2016 registered for the offence under Section 304B/34 of the Indian Penal Code, which is pending in the court of the learned A.D.J.-IX, Patna.
Learned counsel for the petitioner submits that the charge has already been framed and, therefore, the petitioner may be extended the privilege of bail.
However, considering the fact that the petitioner is the husband and has a moral responsibility to take care of his
Patna High Court Cr.Misc. No.44479 of 2018 (2) dt.10-08-2018 2/2 wife, I am not inclined to grant regular bail to the petitioner. It is, accordingly, rejected.
Let the trial of the case be expedited and same be conducted on day to day basis so as to ensure that the same is concluded within a period of six months from today. (Anjana Mishra, J) PNM U T
