The petitioner apprehends his arrest in connection with Thawe P.S. Case No. 127 of 2019 for the offence registered under Sections 414, 428, 429 and 34 of the Indian Penal Code and Section 11(D) (E) (F) of Animal Cruelty Act. The allegation is regarding seven calfs being taken in a pick up van and when the pick up van was intercepted by the Police, some co-accused persons were arrested and they are said to have taken the name of the petitioner as the person who had fled away from the scene of occurrence.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that though the petitioner is owner of the
Patna High Court CR. MISC. No.82079 of 2019(2) dt.11-12-2019 2/2 said vehicle in question, however, the same was being used by the arrested person.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on anticipatory bail in the event of his arrest/surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Thawe P.S. Case No. 127 of 2019 subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) S.Sb/- U T
