Mr. Avinash Raj ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 19-02-2025 Heard learned counsel for the petitioner as well as learned APP for the State.

2. In this case, the petitioner is seeking regular bail in connection with Shikarpur P.S. Case No. 602 of 2024, registered for the offences punishable under Sections 80, 3(5) of Bharatiya Nyay Sanhita.

3. The marriage of the deceased was solemnized with brother of the petitioner as per muslim rituals on 27.06.2024. As per allegation, the accused persons including the petitioner used to abuse the deceased and also subjected her to torture. On 28.08.2024 at about 7:00 a.m., the informant got an information that the accused persons, after putting rope around her neck, killed the deceased.

4. The learned counsel for the petitioner has submitted that the petitioner is brother of husband of the deceased, having no concern with day-to-day affairs of the couple. He has falsely been

Patna High Court CR. MISC. No.3632 of 2025(2) dt.19-02-2025 2/2 implicated merely because he is family member of husband of the deceased. He is 85 per cent disabled and the postmortem report shows that the cause of death was due to asphyxia which shows that the deceased has committed suicide.

5. On the other hand, the learned counsel for the informant has opposed the prayer for bail and submitted that husband of the deceased is still absconding and has not been arrested as yet.

6. The petitioner is brother of husband of the deceased and he is not supposed to have any concern with day-to-day affairs of the couple.

7. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned ACJM 6th, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 602 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
