The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Mirganj P.S. Case No. 215 of 2019, registered for the offence punishable under sections 147, 148, 149, 341, 323, 307, 324, 504 and 379 of the Indian Penal Code and section 27 of the Arms Act.
As per allegation in the F.I.R., the accused persons are
Patna High Court CR. MISC. No.81666 of 2019(4) dt.24-02-2020 2/2 said to have assaulted the informant and others and Pappu Singh Kushwaha is stated to have shot Ramji Choudhary. It is submitted by learned counsel for the petitioner that the main allegation of overt act is on Pappu Singh Kushwaha and not against this petitioner. Co-accused Shahbaj has been enlarged on anticipatory bail vide order dated 19.12.2019 passed in Cr. Misc. No. 84373 of 2019 and the five petitioners herein have no criminal antecedent. Having heard learned counsels for the parties, in the facts and circumstances as stated above, this Court is inclined to enlarge the petitioners on bail.
The petitioners are directed to surrender in the Court below within a period of six weeks from today and in the event of their arrest or surrender, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Mirganj P.S. Case No. 215 of 2019, subject to the condition as laid down under section 438(2) of the Cr.P.C.
