In this case, the petitioner is seeking bail in connection with Sessions Trial No. 133 of 2019 (102 of 2019) arising out of Belaganj P.S. Case No. 336 of 2017 registered for offences under sections 304(B) and 34 of the Indian Penal Code. The petitioner is the husband.

An allegation has been made that the victim girl has been killed on account of non-fulfillment of demand of dowry.

Learned counsel for the petitioner submits that earlier the petitioner had moved before co-ordinate Bench of this Court wherein vide order dated 15.2.2019 passed in

Patna High Court CR. MISC. No.82512 of 2019(7) dt.19-01-2021 2/2 Cr.Misc. No. 3015 of 2019, an observation was made for conclusion of the trial within a period of nine months but, there is no such stage of the trial.

It appears that on account of pandemic, the trial could not be concluded in time but, now gradually the normalcy is being restored.

Looking to the entire facts and circumstances of the case, the prayer for bail of the petitioner, above named, is rejected with a direction to the court below to conclude the trial on day-to-day basis within a period of nine months from the date of receipt of this order.

The Senior Superintendent of Police, Gaya is also directed to ensure production of the prosecution witnesses on the date fixed by the trial court.
