This is the second attempt on behalf of the petitioner for grant of bail in connection with Bihta P.S. Case No.424 of 2022 (Sessions Trial No.708 of 2023) registered for the offence under sections 304-B & 302/34 of the Indian Penal Code. Earlier, the prayer of the petitioner for grant of bail has been rejected by a coordinate Bench of this Court vide order dated 24.07.2023 passed in Criminal Miscellaneous No.25124 of 2023 with direction to the trial court to expedite the trial and conclude the same as soon as possible.

One country made pistol and live cartridges have been recovered from the petitioner.

The petitioner is the husband of the deceased. Allegation has been made against the petitioner that he has

The petitioner is in custody 17.05.2022.

It has been submitted by learned counsel for the petitioner that in the trial not even a single witness has been examined.

Considering the delay in trial, this bail application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Danapur, Patna / concerned Court below, in connection with Bihta P.S. Case No.424 of 2022 (Sessions Trial No.708 of 2023), subject to the condition that he will cooperate in the trial and will appear through his advocate or himself on the dates fixed in the trial.
