JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-12-2019 The petitioner seeks regular bail in connection with Special Case No. 5628/2019 arising out of Paliganj P.S. Case No. 215 of 2019, registered for offences punishable under Sections 341, 323, 307, 498(A) and 427 of the Indian Penal Code and Section 37(b)(c) of the Bihar Prohibition and Excise Act, 2016 and Section 3/4 of the Dowry Prohibition Act. Allegation against the petitioner, who happens to be husband of the informant is of demand of dowry from the informant and assaulting her in drunken condition. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and allegations are general in nature and he has been in judicial custody for five and half months and chargesheet has been submitted and there is no chance of tampering with the evidence.

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna, in connection with Special Case No. 5628/2019 arising out of Paliganj P.S. Case No. 215 of 2019.
