2. The present application has been filed on behalf of the petitioner seeking cancellation of the regular bail granted to the O.P. No. 2 vide order dated 16.11.2024 passed by the learned Sessions Judge, Sitamarhi in B.P. No. 1241 of 2024 without considering that earlier vide order dated 07.08.2021, the O.P. No. 2 was granted anticipatory bail.

3. Perused the records.

4. Having considered the submissions of the parties and the materials available on record, this Court finds that no supervening circumstance has been brought on record to show

Patna High Court CR. MISC. No.11046 of 2025(2) dt.23-07-2026 2/2 that O.P. No. 2 has misused the privilege of bail or violated any of the conditions imposed by the learned court below. No material has been placed before this Court to justify interference with the order granting bail. Therefore, this Court finds no sufficient ground to interfere with the impugned order.

5. Accordingly, the present application is dismissed.

6. However, the petitioner is at liberty to file a maintenance case, if not already filed, before the learned Principal Judge, Family Court, Sitamarhi in accordance with law and if any such maintenance case is filed, the same shall be considered and disposed of by the learned Principal Judge, Family Court, Sitamarhi expeditiously.
