In the present writ petition, the petitioner challenging the order dated 07.06.2018 vide Memo No. 653(4), by which he has been transferred from M.J.K. Hospital Bettiah to P.M.C.H. Patna. The petitioner is posted as Head Clerk at M.J.K. Hospital Bettiah and in the last year of service he has been transferred from Bettiah to Patna.

Learned counsel for the petitioner submits that it will cause immense problem to the petitioner in the matter of his retrial benefit after superannuation from service placed reliance on the circular of the State Government dated 08.10.2014 which

Patna High Court CWJC No.14006 of 2018 (2) dt.28-08-2018 2 /2 prescribes that normal transfer should be done in month of June of every year and in the last year of service normally a person should be given place of posting of his choice. He has already filed representation before the competent authority. In such view of the matter, the Principle Secretary as well as Director-in-Chief, Health Services, Government of Bihar, Patna are directed to consider the representation of the petitioner sympathetically, which deciding representation will take into consideration the resolution of the State Government, accordingly, will pass an appropriate order within three weeks from the date of receipt/production of a copy of this order. In the meantime, status quo as of today shall be maintained with respect to the petitioner.
