The petitioners seek bail in connection with Noorsarai P.S. Case No. 37 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. 258 liters of country made liquor is said to have been recovered from the village Birpur and six accused persons, including petitioners, managed to escape, who were identified by the locals and Chowkidar.

It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from the conscious physical possession of the petitioners. They have no concern with the seized liquor or place of recovery or any

They were not apprehended on the spot. They have no criminal antecedent. They have been languishing in custody since 18.06.2018.

Considering the facts, aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Noorsarai P.S. Case No. 37 of 2018 to the satisfaction of the Additional District & Sessions Judge VI-cum-Special Judge, Excise Act, Nalanda at Biharsharif.
