JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 18-07-2018 This writ petition by a mother of a ward studying in the Awasiya Model Middle School, Bhaisasur, Biharsharif, Nalanda indicating that there is some dispute with regard to who should be the Head Mistress of the institute in question and it is the grievance of the petitioner that one of the Head Mistresses has locked the school premises. It is not being opened and the studies not only of the petitioner's ward, but other children also are being adversely affected and hostel facilities are curtailed. The nature of dispute being administrative as to who should be the Head Mistress of a school, we are not interfering

Patna High Court CWJC No.13802 of 2018(2) dt.18-07-2018 2/2 into the matter. Liberty is granted to the petitioner to take up the issue in administrative side.

We are of the considered view that the Director, Secondary Education and the District Education Officer, Respondent Nos. 2 and 3 should look into the matter. We request the Advocate General, present in the court, to take note of the grievance of the petitioner and forward to the Respondent Nos.2 and 3 the issue of locking of the school and making it non-functional. The authorities are directed to ensure that the locks are removed and school becomes functional. The District Magistrate shall ensure that adequate protection is granted for the purpose of opening of the school and making it functional.
