The petitioner seeks regular bail in connection with Saksohra PS case no. 13 of 2016 instituted for the offence punishable under Section 304/34 of Indian Penal Code. The allegation is regarding some altercation having taken place in between the accused persons and the deceased, whereafter the deceased is stated to have jumped in the river and had drowned.
The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case, is having a clean antecedent and is languishing in custody since 21.06.2019. It is further submitted that similarly
Patna High Court CR. MISC. No. 86771 of 2019(2) dt.17-01-2020 2/2 situated co-accused persons have already been granted bail by a co-ordinate Bench of this Court vide order dated 04.12.2019 passed in Cr. Misc. no. 60404 of 2019.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that the petitioner is having a clean antecedent and similarly situated co-accused persons have already been granted bail by a co-ordinate Bench of this Court, I deem it fit and appropriate to release the abovenamed petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Barh, Patna in connection with Saksohra PS case no. 13 of 2016.
