JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 9.8.2017 passed in Cr.Misc.No. 24228 of 2017 with an observation to conclude the trial within a period of nine months.

Submission of learned counsel for the petitioner is that petitioner is in custody since 18.4.2017 and informant has been examined in this case who has not named the petitioner and his name has come in the confessional statement of co-accused. Heard learned APP also and from perusal of report it appears that only one witness has been examined as yet. Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail

Patna High Court Cr.Misc. No.44560 of 2018 (3) dt.05-09-2018 2/2 on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Naugachhia in the district of Bhagalpur, in connection with Sessions Trial No. 203 of 2017, arising out of Bihpur (Jhandapur) P.S.Case No. 73 of 2016, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner has to co-operate in disposal of trial and appear before the trial court as and when required, otherwise his bail bond shall be cancelled.
