2. The petitioner seeks regular bail in connection with Desri P.S. Case No. 57 of 2023 registered for the offence under Section(s) 414, 467, 468 and 471 of the Indian Penal Code and Section 8, 20(b)(ii)(B), 23(c) and 27(b) of the NDPS Act.

3. As per the prosecution case, there is recovery of 20 Kg of ganja from the motorcycle driven by the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Petitioner is in custody since 16.02.2023. He also submits that out of four witnesses, only one witness has been examined.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances and the delay in trial, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Desri P.S. Case No. 57 of 2023 subject to conditions that:- (i). The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner.

(ii). The bailors will be close blood relatives of the petitioner.
