The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 120B, 354 of the Indian Penal Code and Section 67 of I.T. Act. The prosecution case, as per the Kristi Kumari submitted to the Station House Officer of Chiksaura Police Station, is to the effect that the petitioner has sent some obscene video of the informant on the mobile of the informant and her brother for humiliating the informant and her family members in the society.

It is submitted by learned counsel for the petitioner that the petitioner has been made accused only to spoil the career of the petitioner and a statement has been made in paragraph 3 of the petition that the petitioner is not having any

Patna High Court CR. MISC. No.81943 of 2019(2) dt.14-02-2020 2/2 criminal antecedent. Moreover, similarly situated co-accused Raj Kumar Singh has been granted anticipatory bail by Coordinate Bench of this Court vide order dated 17.09.2019 passed in Cr. Misc. No. 58589 of 2019.

Learned APP submits that the petitioner is named in the FIR with specific accusation.

Considering the nature of accusation and the fact that for the occurrence of 05.07.2019, the FIR has been lodged on 17.07.2019, coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Hilsa, Nalanda in connection with Chiksaura P.S. Case No. 62 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
