JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-09-2018 The petitioner seeks regular bail in connection with Mahnar P.S. Case No. 274 of 2017, registered for offences punishable under Sections 302, 120(B)/34 of Indian Penal Code and Section 27 of the Arms Act.

Allegation as per F.I.R is that four miscreants entered inside the shop of the brother of informant and shot him dead and it is alleged that the petitioner is the conspirator in murder of brother of informant.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and there is no allegation of causing death of the deceased and he has been made accused in this case only on the basis of suspicion that petitioner is the conspirator in the murder of brother of informant and co-accused

Patna High Court Cr.Misc. No.45268 of 2018 (3) dt.07-09-2018 2/2 of this case, namely, Sheetal Gupta has already been enlarged on bail by a coordinate Bench of this Court vide order dated 20.06.2018 passed in Cr. Misc. No. 35459 of 2018. Learned counsel for the State opposed the prayer for bail and submitted that the petitioner and his wife is the main conspirator in this case and further he is an accused in eight other cases.

Having heard both sides, considering the fact and circumstances of the case and also the fact that petitioner is accused in eight other cases out of which four case is under Section 302 of the IPC, as such, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
