The petitioner seeks regular bail in connection with Pusa P.S. Case No.16 of 2018 registered for offences punishable under Section 414 of the Indian Penal Code.

Allegation against the petitioner is of recovery of three motor cycle and one bolero vehicle from the outside his house. Submission of the learned counsel for the petitioner is that he has got no concern with the alleged theft of motorcycle and with other co accused. Nothing has been recovered from possession of petitioner and in the seizure list signature of the petitioner was taken. He has no criminal antecedent and he is languishing in custody since 04.06.2018.

Heard learned A.P.P. also.

No.45229 of 2018 (3) dt.07-09-2018 2/2 Having heard both sides and in view of the facts as stated above, at this stage, I am not inclined to grant bail to the petitioner at this stage. However, once the charge has been framed in this case against the petitioner, the learned trial Court shall release him on bail on his own satisfaction without being prejudice the order passed by this Court.
