The petitioner is apprehending his arrest in a case registered under Sections 419, 420 and 120(B) of the Indian Penal Code.

The prosecution allegation, in short, is that accused person was helping a person in the examination who was impersonating in place of another person.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is not named in the F.I.R.. As per the allegation, in place of Ruby Kumari, some other candidate was

Patna High Court CR. MISC. No.81956 of 2019(2) dt.18-12-2019 2/2 appearing in the examination. The petitioner happens to be Invigilator. He is being suspected to have assisted the candidate in question. Except for suspicion, there is no other substantive evidence to suggest his implication in the present case. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Industrial P.S.
