2. The petitioner is seeking regular bail in connection with Rajpur P.S. Case No. 224 of 2024 for the offences punishable under Sections 25(1-B)a,26,35 of the Arms Act.

3. As per allegation, one loaded country-made pistol was recovered from co-accused Ravi Kumar whereas Rs. 50,000/- is said to have been recovered from possession of coaccused Alok Kumar @ Pritam. It is further alleged that the apprehended co-accused persons disclosed the name of this petitioner.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.1317 of 2025(2) dt.28-02-2025 2/2 this case. Nothing was recovered from his possession. He is under custody since 29.07.2024. He has also submitted that on exactly similar footing, co-accused Ritesh Kumar @ Ritesh Kumar Yadav has been granted regular bail by this Court vide order dated 01.10.2024 in Cr. Misc. No. 68333 of 2024. It has also been submitted that in all the cases except one, as mentioned in paragraph no. 3 of the bail petition, the petitioner has been acquitted.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Buxar in connection with Rajpur P.S. Case No. 224 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
