The petitioner seeks regular bail in connection with Belhar P.S. Case No. 137 of 2019 for the offences punishable under Sections 341, 323, 364/34 of the Indian Penal Code. The allegation is regarding the co-accused person, namely, Hira Rajak having assaulted the son of the informant, whereafter the son of the informant had gone missing. It is further alleged that the said Hira Rajak and others had made the son of the informant disappear.

The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the petitioner is an old person aged about 70 years and is stated to be the father of the

Patna High Court CR. MISC. No.81587 of 2019(2) dt.11-12-2019 2/2 said Hira Rajak, hence only on account of being the father of the accused, he has been falsely implicated in the present case. It is further submitted that similarly situated co-accused persons have been granted bail by a co-ordinate Bench of this Court vide order dated 18.10.2019 passed in Cr. Misc. No. 63069 of 2019. Lastly it is submitted that the petitioner is having a clean antecedent.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Belhar P.S. Case No. 137 of 2019.
