JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-06-2020 Heard Mr. Amit Kumar Anand, learned counsel for the petitioner and learned APP for the State. The petitioner, who is in custody since 21.09.2019 seeks bail in connection with Barhara P.S. Case No. 120 of 2019 dated 12.069.2019 instituted for offence under Section 394 of the Indian Penal Code.

The petitioner is not named in the First Information Report. The informant has alleged that he was waylaid and divested of his belongings by unknown persons. Name of petitioner appears to have transpired during the course of investigation. The materials collected against the petitioner is of recovery of a mobile phone, which is said to be

Learned counsel for the petitioner has submitted that IMEI Number mentioned in the alleged mobile phone is different from the IMEI Number of mobile phone, which has been recovered from the house of the petitioner. The aforesaid mobile phone was purchased by the petitioner in second hand from his co-villager, namely, Mukul Yadav. He has further submitted that petitioner has no criminal antecedent and he is in custody since 21.09.2019. Regard being had to the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate -1st Class, Purnea, in connection with Barhara P.S. Case No. 120 of 2019.
