JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-10-2018 The petitioners are in custody since 05.06.2018 in connection with Navanagar (Sonvarsha) P.S. Case No. 68 of 2018, registered for offences punishable under Sections 392 and 412 of the Indian Penal Code.

Allegation as per F.I.R is that some miscreants snatched away the Bolero vehicle of the informant. Submission of learned counsel for the petitioners is that they have not named in the F.I.R., later on their names transpired on the basis of report of the spy and also confession statement of the petitioners, but there is no recovery from the possession of the petitioners. The petitioners are in custody since 05.06.2018.

Patna High Court Cr.Misc. No.48075 of 2018 (3) dt.01-10-2018 2/2 Heard learned A.P.P. also, who opposed the prayer for bail of the petitioners.

Having heard both sides, in view of the facts and circumstances as stated above, at this stage, I am not inclined to grant bail to the petitioners. However, once the charge is framed against the petitioners and the trial is commenced, the learned Trial Court shall release the petitioners on bail to his own satisfaction.
